A place that the black community despised not only because they weren’t allowed to work there, but because they knew how close they were to having their home become lost and forgotten: just like the tunnel, just like Chicken Little, just like the town’s identity. It would seem logical for this shared identity of a black community in first half of the 20th century to revolve around race. Especially when there is an impending white community right across the river that is inevitably going to engulf the Bottom. Many blacks respond to the white culture with hatred and violence. However, due to the way white culture has shaped society, whiteness is the people of the Bottom’s only standard for beauty and prosperity. And their standard for ugliness is Sula. The people of the Bottom self-designed their culture around Sula’s life so they could avoid their notion of ugliness. They do not envy white culture for denying them work or health care. Instead, they are obsessed with removing the preconceived cancer that the community thought had cursed their lives. Through Sula’s death, the black community expected a cultural renaissance. But as Morrison prophesized, their culture would not survive and the earth where Sula and Nel buried g arbage, the earth that destroyed the tunnel, and the earth where the entire neighborhood stood was replaced to make room for the Medallion City Golf Course.

One serious theme that I noticed in â€Å"The Importance of being Ernest† was the consistent act of deception throughout the entire play. One of the primary test for the purpose of determining whether the defendant owes a duty of care to the plaintiff is the known as the caparo test. This test is used to analyze whether a duty of care was owed in relation to a physical injury. This test had been provided through the landmark case of Caparo Industries pIc v Dickman [1990] 2 AC 605. In this case it had been provided that the concepts of proximity, reasonability, foreseeability of the defendant in relation to the duty of care being present has to be established. This means that if the defendant is able to foresee damages which may arise out of his actions to the plaintiff and the defendant is in close proximity with the plaintiff than it is deemed that the defendant owes a duty of care to the plaintiff. These principles had been discussed in the case of Corporation of the Synod of the Diocese of Brisbane v Greenway [2017] QCA 103. The test which is commonly deployed to analyze the presence breach of the duty is known as the objective test. The test had been provided through the landmark case of Vaughan v Menlove (1837) 3 Bing. N.C. 467. The rules of the test takes into consideration of the actions of reasonable person to determine the compliance with the duty. As per this case the defendant was held liable for the breach of duty because when a reasonable person was placed in the same situation as him and would have taken additional care of the situation. The third and final element of negligence is causation and the court determines it generally through putting into the situation the but for test when the issue is related to physical injury. The test has been established through the landmark case of Barnett v Chelsea Kensington Hospital[1969]. The concept of the test is simple, negligence of the injury would not have been caused but for the breach of directors duties. As per the facts of the case the plaintiff was a relative of a person who is dies due to the alleged negligence by a hospital who is the defendant. In this case the plaintiff was suffering from a terminal disease and would have died even if the doctor had not violated the duty of care. Therefore in the given situation there was no negligence. In this situation only those damages can be recovered by the plaintiff in case negligence is determined, which can be reasonable foreseeable by a reasonable person in the same situation. The provisions of this case also have been applied in various cases across Australia such as the case of Murphy v Brentwood DC [1991] AC 398 When the presence of negligence has been determined the defendant has the right to avail certain defenses under the provisions of common law which may reduce or abolish the liability owed by the defendant to the plaintiff. This defense of commonly called contributory negligence . One of the primary cases in Australia where the concept of contributory negligence had been discussed by the court is the case of Railways v Halley [1978] 20 ALR 409. In this case the presence of this defense reduced the liability of the defendant owed to the plaintiff with respect to negligence. The process of establishing contributory negligence is the same which is used for establishing negligence. In this situation the defendant has a duty of care towards himself and thus he must act as a reasonable person in same circumstances and taken the same level of care towards himself. In addition the injury would not have been caused to him if he was not himself negligent. Once the presence of contributory negli gence is determined in the case the liability of the defendant may be reduced or abolished. The damage in relation to the negligent act is proportionated by the court based on the level of negligence made by the plaintiff himself. The above discussed proportion has been done by the court in the case of Jackson v McDonalds Australia Ltd[2014] NSWCA 162 where the situation involved a slip and fall case. In this case the court held that there was 30% contribution of damages in form of contributory negligence by the plaintiff himself and thus he damages were reduced by 70%. Application Thus from the above discussed provisions it is clear that a systematic approach is required for the purpose of establishing negligence. Thus establishing negligence requires a three step process. Duties of care, breach of duty and causation have to be established one after the other. In this case it has been provided that Alice is the owner of the boat in which the accident was involved. In the situation it has also been stated that Marcos was her client who met the accident. Thus here Alice would be the defendant and Marcos would be the plaintiff. In this situation while determining the presence of a duty of care the principles of the Donogue case has to be applied. In addition the caparo test also needs to be applied in the situation. While applying the test in the given situation it can be determined that Alice would have seen that her actions would have reasonably and foreseeably harm any person present on the boat. In addition the Alice was in close proximity to Marcos. Thus a d uty of care is owed by Alice to Marcos. The duty of care can further be established through the application of the neighbor principle. In the given situation it is evident that negligence of Alice will harm Marcos thus a duty of are exists. The establishment of breach of duty of care is the next process in the situation. This is done through the application of the objective test as provided through the Vaughan case. When a reasonable person is placed in the situation of Alice, she would have ensured that the floor of the boat is properly matted so that there is no accident. In addition when the accident had been caused a reasonable person would have ensured that the boat is taken back, which was not done by Alice. Thus it is clear that the objective test has not been satisfied and the duty of care has been breached by Alice. No reasonable person would have indulged in the actions which had been indulged by Alice in the situation. Further the element of causation needs to be established. In this situation therefore the but for test has to be applied in the given situation. It has been provided in the given situation that Marcos had slipped on the wet flooring of the boat. In this situation through the application of the test it can be determined that Marcos would not have been injured in situation where the floor of the boat was not wet. Thus the application of the but for test in this case has been satisfied. In the same the element of causation in this situation has also been established. Thus in the given situation where all elements have been established there is negligence in the case. A reasonable person would foresee the damages which have been caused to Marcos in the given situation. Thus Alice based on the test of remoteness of damages is liable to compensate Marcos. BTK Strangler Dennis Rader Profile On Friday, February 25, 2005 suspected BTK Strangler, Dennis Lynn Rader, was arrested in Park City, Kansas and later charged with 10 counts of first-degree murder. The day following his arrest Wichita Police Chief Norman Williams announced in a press conference, the bottom line is that BTK has been arrested. Raders Early Years Rader was one of four sons to parents William and Dorothea Rader. The family lived in Wichita where Rader attended Wichita Heights High School. After a brief attendance in 1964 to Wichita State University, Rader joined the U.S. Air Force. He spent the next four years as a mechanic for the Air Force and was stationed abroad in South Korea, Turkey, Greece, and Okinawa. Rader Leaves the Air Force After the Air Force, he returned home and began working on obtaining his college degree. He first attended Butler County Community College in El Dorado then transferred to Kansas Wesleyan University in Salina. In the fall of 1973, he returned to Wichita State University where in 1979 he graduated with a major in Administration of Justice. A Work History With A Common Thread While at Wichita State he worked part-time in the meat department at an IGA in Park City.From 1970 to 1973 he was an assembler at the Coleman Company, assembling camping gear and equipment.From November 1974 to July 1988 he worked for a home security company, ADT Security Services, where he had access to homes as an installation manager. It has also been noted that the business increased as community fear of the BTK killer increased.From 1990 until his arrest in 2005, Rader was a supervisor of the Compliance Department at Park City, a two-maned, multi-functional department in charge of animal control, housing problems, zoning, general permit enforcement and a variety of nuisance cases. His performance in his position was described as overzealous and extremely strict by neighbors.He also served as a census field operations supervisor in 1989. Active in Church and a Cub Scout Leader Radar married Paula Dietz in May 1971 and had two children after the murders began. They had a son in 1975 and a daughter in 1978. For 30 years he was a member of the Christ Lutheran Church and was an elected president of the Congregation Council. He was also a Cub Scout leader and was remembered for teaching how to make secure knots. The Trail That Led Police To Raders Door Enclosed in a padded envelope sent to the KSAS-TV station in Wichita was a purple 1.44-megabyte Memorex computer disk that the FBI was able to trace to Rader. Also during this time a tissue sample of Raders daughter was seized and submitted for DNA testing. The sample was a familial match to the semen collected at one of the BTK crime scenes. The Arrest of Dennis Rader On February 25, 2005, Rader was stopped by authorities while in route to his home. At that point, several law enforcement agencies converged on Raders home and began searching for evidence to link Rader to the BTK murders. They also searched the church he belonged to and his office at City Hall. Computers were removed at both his office and his home along with a pair of black pantyhose and a cylindrical container. Rader is Charged With 10 BTK Murders On March 1, 2005, Dennis Rader was officially charged with 10 counts of first-degree murder and his bond set at $10 million. Rader appeared before Judge Gregory Waller via video conference from his jail cell and listened to the 10 counts of murder read against him, while family members of his victims and some of his neighbors watched from the courtroom. On June 27, 2005, Dennis Rader plead guilty to 10 counts of first-degree murder then calmly told the court the chilling details of the Bind, Torture, Kill slayings that terrorized the Wichita, Kansas area between 1974 and 1991. Family Response It is believed that Paula Rader, who has been described as a gentle and soft-spoken woman, was shocked and devastated by the events that transpired with the arrest of her husband as were her two children. As of this writing, Mrs. Rader has not been to visit Dennis Rader in prison and she and her daughter are reportedly out of state in seclusion.
